Terms and Conditions
SRI GOLD Private Limited (“SRI GOLD”)
1. Ownership and Authenticity of Gold Items
SRI GOLD will only accept gold items that are exclusively owned by the Seller.
The Seller confirms that the gold items were acquired through purchase, gift, or inheritance and that he/she/they have full legal authority to sell them.
The Seller is solely responsible for the authenticity and rightful ownership of the items presented for sale.
2. Non-Return Policy
Once the transaction is completed and the gold items are sold, SRI GOLD will not return the items under any circumstances.
The Seller acknowledges that all sales are final and irrevocable.
3. Payment Terms
Upon successful purchase, SRI GOLD will pay the value of the gold items only in Indian Rupees (INR) through a bank transfer to the Seller’s account.
Payments will not be made in cash or in any other form unless expressly agreed in writing.
4. Rights of SRI GOLD
SRI GOLD reserves the absolute right to accept or reject any sale offer without providing justification.
Once purchased, SRI GOLD gains full ownership and title of the gold items and may:
• Sell, transfer, assign, or securitize them;
• Melt, reprocess, or sell them to third parties, companies, or other entities.
5. Seller’s Legal Responsibility
If the sold items are later discovered to be stolen, counterfeit, or spurious, the Seller (or their legal representatives) will be solely liable for:
• Repayment of the entire amount received, with applicable interest and damages;
• Any legal, criminal, or financial consequences arising therefrom;
• Indemnifying SRI GOLD for all losses, damages, and legal costs incurred.
SRI GOLD may report such incidents to law enforcement or relevant authorities.
6. Verification and Compliance
SRI GOLD reserves the right to verify the pledge information and ownership details provided by the Seller.
If any information is found to be false or misleading, SRI GOLD may:
• Report it to concerned government or statutory authorities;
• Take necessary legal actions to protect its interests.
7. Pledged Gold Transactions
If the Seller fails to release pledged gold after SRI GOLD has paid the financier, or changes their mind about selling, the Seller must reimburse the total advance amount immediately.
Failure to reimburse by the end of the transaction day will be treated as a completed sale to SRI GOLD.
If the actual gold value is less than the advance paid for pledge release, the Seller must pay the difference amount to SRI GOLD without delay.
8. Purity Testing and Valuation
Purity of gold will be assessed using XRF technology by an authorized evaluator at SRI GOLD’s store.
Purity readings may vary depending on the testing method used.
SRI GOLD shall not be responsible for:
• Variations in purity or weight after melting;
• The inability to restore the ornament’s original shape or design after testing or melting.
Additional tests (acid, salt, or others) may be conducted if required to confirm purity.
Non-gold components (e.g., stones, soldering materials) will be deducted from total weight before valuation.
The valuation will be based on the prevailing 24-carat gold market rate on the date of melting/purchase, subject to daily fluctuations.
9. Biometric and Personal Data
SRI GOLD may collect biometric details of the Seller solely for record and verification purposes.
All personal data will be kept confidential and used only for legitimate business purposes in accordance with applicable data protection laws.
10. Age Restriction
Sellers below the age of 21 years must be accompanied by their legal guardian.
Both the Seller and guardian will be equally responsible for the transaction and its consequences.
11. Change of Mind after Testing
If the Seller decides not to sell after the ornament has been dismantled or melted for testing, SRI GOLD reserves the right to charge up to 5% of the valuation amount as service fees.
This fee may be adjusted in cash or gold, as mutually agreed.
12. Limitation of Liability
SRI GOLD shall not be responsible for any loss, damage, or depreciation of gold items arising from the testing or melting process.
SRI GOLD will not be liable for any misuse of sales proceeds by the Seller, including any illegal, anti-national, or criminal activities.
13. Dispute Resolution
All disputes arising out of or related to this transaction shall be resolved through binding arbitration under Indian Arbitration Law.
The jurisdiction for all disputes shall be Hyderabad, Telangana.
By completing a sale transaction with SRI GOLD Private Limited, the Seller acknowledges and agrees to the above Terms & Conditions in full.
